Where are the Law Offices of Kennedy and Brown located?
In September of 2001, we moved into our current offices located at 3052 Lebanon Road, a restored historic, two-story home across the street from Donelson Corporate Center. From Nashville, take Interstate 40 East to Stewart's Ferry Pike Exit, turn Left on Stewart's Ferry Pike, turn Right on Lebanon Road. You will see our sign on your left across the street from the Donelson Corporate Center, immediately preceding the intersection of Lebanon Road and Danyacrest Drive. From Hermitage, we are just over the Stones River Bridge after the third traffic light on your right.
How can Kennedy and Brown, PLLC help me?
We are engaged in the general practice of law and handle all types of civil and criminal litigation. If you have been recently injured in an automobile collision or on the job, if you are having marital problems or problems with your ex-spouse, if you have been charged with a crime, if you have recently lost a loved one, if you need a will, living will or power of attorney or if you have any other type of dispute or claim, you may need the advice or assistance of our office.
What types of cases does Kennedy and Brown, PLLC handle?
Much of our practice is focused on helping injured victims who have been hurt as the result of automobile accidents or while on the job. We also handle all types of family law, including divorce, custody, adoptions, prosecution and defense of petitions for contempt or to modify, child support and visitation cases. We handle criminal defense of both misdemeanors and felonies, including drug cases, DUI, theft, assaults and other charges. We can create a business for you including a corporation or LLC, or handle business litigation, such as breach of contract or fraud cases. We handle Probate matters, such as Decedent's Estates, Conservatorships and Guardianships. We also handle property disputes and Declaratory Judgment actions and insurance matters.
Is the initial consultation free?
If you have been injured in an auto accident or at work, you may make an appointment with our office for a FREE consultation with an attorney to discuss and evaluate your potential claims. At home or hospital visits are available. In non-injury civil matters and criminal cases, office consultations are subject to the attorney's hourly rate.
What kind of attorneys fees and costs can I expect with Kennedy and Brown?
Personal injuries or property damage cases arising from automobile accidents, wrongful death claims, or cases based upon negligence, malpractice or defective products are generally handled on a contingency basis where the attorney would receive one-third (1/3) of all monies collected. In workman's compensation cases and social security disability cases, where your damages may be limited by statute, our contingency fees are likewise limited to twenty (20%) and twenty-five (25%) percent, respectively. In personal injury cases, workman's compensation, and disability cases, we are not paid unless you collect.
In civil, non-injury matters, such as family law, business litigation, probate, conservatorships, guardianships, or Landlord/Tenant matters, all attorney's fees are subject to the respective attorney's hourly rate, which are currently set at $175.00 per hour. Our retainer fees for lawsuits generally range from $500.00 to $2,500.00, and are subject to the respective attorney's hourly rate. Retainers for criminal or civil appeals are based upon the issues, the level of the appellate process, and the complexity of the litigation.
In criminal cases, we generally represent our clients on a flat fee basis on either the General Sessions and/or Criminal/Circuit court level(s), and these fees are based upon the number of charges, the seriousness of the charge(s), and the expected time necessary to handle the case.
Clients are generally expected to pay the costs, including court costs, filing fees, expert witness fees, appraisal costs, deposition costs, and court reporter fees, which may be associated with his/her case, as they accrue. We do not charge expenses for travel, long distance phone calls, copies or postage. In some injury cases, we may agree to advance some costs, but the client will ultimately remain responsible for same.
When should I contact a lawyer?
The sooner you hire a lawyer to assist with your case, the better that lawyer may be able to serve you. You should probably speak with an attorney before discussing your case with a claims representative, with the district attorney, or with any material witness. If you are dealing with an insurance company, rest assured that said company is backed by a team of attorneys. Please be aware that in Tennessee, if you are injured as the result of another person's negligence or at work, the time for filing a lawsuit is one year from the date of the accident or injury.
To what counties do the lawyers of Kennedy and Brown travel?
We are licensed to practice before all courts in Tennessee and practice regularly before the Circuit, Chancery, General Sessions, and Juvenile Courts of Davidson, Wilson, Rutherford, Robertson, Maury, Williamson and Sumner Counties. We also handle cases in the United States District Court, Middle District. We will travel to counties outside of those listed above in the State of Tennessee.
